Essential Booking and Payment Terms

These essential terms regulate the booking, payment and certain organisational aspects of the photography services provided by Due Unici Wedding.

1. Booking of the date

The date of the photography service is considered reserved only after payment of the confirmatory deposit and confirmation of the booking.

Until the confirmatory deposit has been paid, the date is not considered blocked or guaranteed.

The minimum coverage is 3 hours for local weddings (in and around Genova) and 6 hours for destination weddings. This applies to all packages and proposals.

2. Confirmatory deposit

To reserve the date, the client shall pay 30% of the total amount as a confirmatory deposit pursuant to Article 1385 of the Italian Civil Code.

In the event of cancellation, no-show or non-agreed withdrawal by the client, the confirmatory deposit shall be retained by the photographer.

In the event of proper performance of the service, the deposit shall be deducted from the total price.

3. Balance and cancellation by the photographer

The balance, equal to the remaining 70% of the total amount, shall be paid on the day of the photography service, unless otherwise agreed in writing between the parties.

The final photographic material may be delivered only after full payment of the amount due.

In the event of cancellation by the photographer without a justified reason (causa giustificata), the photographer undertakes to refund the confirmatory deposit in double the amount paid, in accordance with Article 1385 of the Italian Civil Code.

4. Rescheduling of the date

Rescheduling of the date is possible only by prior written agreement and subject to the photographer's availability.

A request to reschedule does not automatically guarantee the availability of a new date.

If rescheduling is not possible due to the photographer's unavailability and the parties are unable to agree on an alternative date, the booking shall be treated as cancelled by the client and the conditions of Section 2 regarding the confirmatory deposit shall apply.

5. Client delay

Any delay by the client does not automatically result in an extension of the service.

The delay time shall be counted within the overall duration of the session, unless the photographer is available otherwise.

6. Delivery of the material

The photographic material shall be delivered according to the terms and methods indicated in the contract.

Unless otherwise agreed in writing, delivery times shall run from the date of the service and/or from the final selection of the images, where applicable, and from payment of the balance.

7. Cookies and Tracking Technologies

RAW files, source files and non-edited files are not included in the delivery, unless otherwise agreed in writing between the parties.

The selection of the shots and the post-production style fall within the photographer's artistic discretion, in accordance with the agreed style and the purchased service.

8. Use of the images by the client

The client may use the delivered photographs for personal and non-commercial purposes, including publication on their personal social media profiles, unless otherwise agreed in writing.

The sale to third parties, licensing, commercial use, substantial modification of the images or removal of any watermark is prohibited without the photographer's written authorisation.

9. Use of the images by the photographer

The photographer retains the right to use selected photographs for portfolio, website, social media, contests, advertising and other promotional purposes.

Within 10 (ten) days of delivery of the finished photographs, the client may request in writing the exclusion of specific images from such use. If no such request is received within this period, the photographer may proceed with portfolio use at her discretion.

The promotional use of photographs of identifiable minors requires a separate specific written authorisation by the person or persons exercising parental responsibility, regardless of the above.

10. Minors

If minors are present at the photography service, the contract and any authorisation for the use of images must be signed by the person or persons exercising parental responsibility. A separate image release form (liberatoria) will be provided for this purpose.

Consent for the promotional use of images of minors is optional, specific and separate from the performance of the photography service.

11. Privacy

The client's personal data shall be processed exclusively for purposes related to the management of the request, booking, performance of the service, delivery of the material, invoicing and legal obligations.

The processing of personal data is carried out in accordance with the Privacy Policy.

12. File storage

The photographer does not guarantee the storage of files beyond the terms indicated in the contract.

The online gallery, where provided, shall remain available for the period indicated in the contract or communicated to the client.

The client is advised to download and independently store a copy of the delivered material.

13. Extra services

Additional hours, extra photographs, prints, albums, urgent deliveries, travel expenses, parking, entrance fees, permits, locations or other services not included in the quotation shall be charged separately upon prior written agreement.

14. Weather conditions, locations and permits

For outdoor photography services, any changes due to weather conditions, unavailability of the location, access restrictions or lack of permits shall be agreed between the parties.

Any costs relating to locations, entrance fees, authorisations, permits or travel expenses shall be borne by the client, unless otherwise agreed in writing.

15. Language of the documentation

Due Unici Wedding provides contractual documentation, these essential terms, privacy notices and any other formal documentation exclusively in Italian and English.

No documentation in any other language will be provided.

Contractual documentation in languages other than Italian and English is not provided.

At the client's request and subject to availability, documentation may be issued in English. In the event of any interpretative difference between the Italian version and the English version, the Italian version shall prevail.

Any informal communication in other languages is provided solely as a courtesy and does not constitute an official or legally binding version.

16. Applicable law and competent court

The relationship is governed by Italian law.

In the event of any dispute arising from or in connection with these terms or the photography service contract, the parties shall first attempt resolution through good-faith negotiation within 15 (fifteen) days of written notice. If the dispute is not resolved through negotiation, the parties agree to submit it to mediation administered by the Camera di Commercio di Genova. If mediation does not result in a resolution within 60 (sixty) days, the competent court shall be the Tribunale di Genova, without prejudice to any mandatory consumer rights where applicable.

17. Acceptance

Payment of the confirmatory deposit and/or written confirmation of the booking implies acceptance of these essential booking and payment terms.

These terms may be supplemented or amended by the specific contract signed between the parties.
